Washington Administrative Codes (WACs)

DASA has three chapters of rules in the Washington Administrative Code (WAC). DASA works with its stakeholders and the department's Rules and Policies Assistance Unit to ensure rules are written in compliance with the Administrative Procedures Act and the principles of Regulatory Improvement, Regulatory Reform, Clear Rule Writing, and Plain Talk. For questions about WAC changes, call Deb Cummins, Certification Policy Manager at (360) 725-3716, or e-mail cummida@dshs.wa.gov.

WAC 388-800 Chemical Dependency Assistance Programs -- ADATSA.  ADATSA stands for the Alcohol and Drug Addiction Treatment and Support Act, which is a legislative enactment providing state-financed treatment and support to chemically dependent indigent persons.

Certification Requirements for Chemical Dependency Service Providers.  These rules describe the standards and processes necessary to be a certified chemical dependency treatment program. The rules have been adopted under the authority and purposes of the following chapters of law in the Revised Code of Washington (RCW) or in the Code of Federal Regulations (CFR).

WAC 388-805 has been opened for review and changes. 
CR-101 notice: An initial form, filed under RCW 34.05.310, that a state agency files to share with the public the intent to adopt, amend or repeal WACs on a particular subject. WAC 388-810 Administration of County Chemical Dependency Prevention, Treatment, and Support Program (Re the County-State Relationship). The purpose of this chapter is to describe the planning, contracting, and provision of chemical dependency prevention, treatment, and support services through counties (see RCW 70.96A).

Forms: 

On-site technical assistance surveys.   

DASA is a regulatory agency as defined in Chapter 43.05 Revised Code of Washington (RCW).  DASA is required under RCW 43.05.020 to provide technical assistance visits.  DASA Certification Specialists conduct on-site technical assistance surveys a minimum of once every three years of all certified chemical dependency service providers.  Agencies are notified at least 60 days in advance of planned survey dates.  DASA attempts to coordinate its surveys with other regulatory agencies whenever an agency is regulated by more than one governmental entity.  For scheduling and coordination of technical assistance surveys, contact Julián Gonzales, Certification Field Services Manager at (360) 725-3730 or e-mail gonzaJL@dshs.wa.gov.

Opioid Treatment Program (OTP) Accreditation.    

DASA is an approved Substance Abuse and Mental Health Services Administration (SAMHSA), Center for Substance Abuse Treatment (CSAT), Opioid Treatment Program (OTP) Accreditation Body.  DASA is one of six accreditation bodies approved nationwide, and was the first state agency to receive the approval from CSAT.   This approval allows DASA to combine state certification and federal accreditation processes into a single process for OTPs.  This will allow providers to address only one set of regulations and prepare for only one on-site survey by a regulatory agency instead of two.  Approval reduces the overall cost of certification and accreditation to the OTPs, allowing more of their existing resources to be spent on treatment rather than on federal and state regulatory activities.

Adjunctive Medications.

The Health and Recovery Services Administration (HRSA)/DSHS in collaboration with DASA/DSHS has recognized three new medications in the treatment of addictions.  These medications must be prescribed by a physician in conjunction with state certified chemical dependency treatment and require a completed authorization form for Medicaid payment.  For information about Suboxone (Buprenorphine), Campral (Acamprosate), or ReVia (Naltrexone) Authorization forms, see these sites:

Deeming.  

DASA has agreements with three national accreditation organizations to accept their accreditation in lieu of on-site surveys of certified chemical dependency service providers.  Deemed agencies have lower certification fees.  The three accreditation organizations are: 

  1. CARF...The Rehabilitation Accreditation Commission (CARF), 
  2. The Council on Accreditation for Children and Family Services (COA), and
  3. Joint Commission on Accreditation of Health Care Organizations (JCAHO).

Complaint/Incident Management.

Regulatory Improvement.  

This is generally a group of specific activities by state agencies implementing Governor Locke's Executive Order 97-02, and the April 17, 1997 Executive Order of the Secretary of the Department of Social and Health Services (DSHS) on Regulatory Improvement.  These executive orders require agencies to review all their rules every four years and policies every two years for need, effectiveness, efficiency, clarity, compliance with statutory intent, coordination with other agencies, cost benefit, and fairness.  Reviews are conducted to determine if rules need to be repealed or updated and rewritten utilizing clear rule-writing principles. Policies are also reviewed to determine if they need to be made into rules.  In compliance with the Executive Order, DASA maintains an issuance inventory of all their rules and policies that affect people and businesses outside of DASA, and maintains a rule and policy Sunset Review Schedule.  For information about Regulatory Improvement, call Dennis Malmer, Certification Supervisor at (360) 725-3747, or e-mail malmedw@dshs.wa.gov

Regulatory Reform.  

This generally refers to actions taken by the Legislature and state agencies to lessen the regulatory burden of small businesses, particularly businesses that are regulated by more than one governmental agency.  Regulatory reform principles ensure that all rule-making by agencies is both authorized by the Legislature and is a public process, conducted in compliance with the Administrative Procedures Act (APA), Chapter 34.05 RCW.  In compliance with the principles of regulatory reform, DASA writes all rules in compliance with the APA and publishes its Semi-Annual Rule-Making Agenda for any rule development in the Washington State Register  twice a year.   For information about Regulatory Improvement, call Dennis Malmer, Certification Supervisor at (360) 725-3747, or e-mail malmedw@dshs.wa.gov

Plain Talk.  

This refers to activities by state agencies in response to Governor Gregoire's Executive Order on Plain Talk found at http://www.governor.wa.gov/execorders/eo_05-03.pdf . The Executive Order requires all announcements, publications, and other documents that agencies send to the public to contain clear and concise instructions and information, including:

  • Clear language that is commonly used by the intended audience;

  • Only the information needed by the recipient, presented in a logical sequence;

  • Short sentences;

  • Sentences, written in active voice, that make it clear who is responsible for what; and,

  • Layout and design that help the reader understand the meaning on the first try.  This includes adequate white space, bulleted lists, helpful headings, and other proven techniques.

DASA complies with the public disclosure requirements of RCW 42.56.  In DSHS, each division has a Public Disclosure Coordinator.  Requests for disclosure of public information of DASA records should be sent to:

Public Disclosure Forms:

Requests for Patient Records.  

Requests for information about drug and alcohol patient records will need to include a release of confidential information form that meets the requirements of federal regulations on Confidentiality of Alcohol and Drug Abuse Patient Records found in Chapter 42, Part 2, of the Code of Federal Regulations, or a proper court order.  Closed treatment agencies usually maintain their own closed client files.  DASA maintains some closed client files from closed agencies.

  • Authorization DSHS 17-063 
    Use this form when you want DASA/DSHS to release of your confidential patient/client information to another party. If you believe that DASA has archived your closed client/patient file due to a treatment agency closing, call before sending the form.  Most treatment agencies appoint a records custodian to maintain their records when closing, or they maintain their own records. 
     
  • Release of Confidential Information  Use this form to request a certified treatment agency to send your records to another party.  This is a Sample fill-in form (HIPAA & 42 CFR Part 2 compliant).  Do not use this form for records held by DSHS.

DASA's Issuance Inventory.  

The Issuance Inventory is a list of all of DASA's rules (WACs), policies, interpretive statements, and memorandums of understanding with other agencies and organizations that affect groups of individuals and businesses outside of DASA.  The Issuance Inventory is required by Governor Locke's Executive Order 97-02 on Regulatory Improvement.  For each issuance, the inventory identifies its statutory authority, date adopted or last amended, the next planned review period, and the date of the last action taken on the issuance, such as the date it was retained, amended, or repealed.  For questions, call Dennis Malmer, Certification Supervisor at (360) 725-3747, or e-mail malmedw@dshs.wa.gov.

DASA's Sunset Review Schedule.  

This is a review schedule for all DASA's issuances (rules, policies, and interpretive statements), which affect groups of individuals and businesses outside of DASA), internal policies, and other documents maintained by DASA for public information.  The schedule identifies each document and its sunset review date, the section in DASA responsible for the review, the date the last sunset review was completed, and the last action taken on the document, such as, new, retained, revised, or repealed.  The schedule ensures that all the above documents are reviewed at least once every two years to ensure they are still needed, effective, efficient, clear, coordinated with other agencies, have a cost benefit, are fair, and are in compliance with statutory authority, intent, and the ADA.  For questions call Dennis Malmer, Certification Supervisor at (360) 725-3747, or e-mail malmedw@dshs.wa.gov; or Jennifer Fine at (360) 725-3703, e-mail finejk@dshs.wa.gov.

DASA's Semi-annual Rule-making Agenda.  

This is a biannual report the department publishes in the Washington State Register to inform the public of the rules the department will be developing or revising during the following six months.  The report is available in the Washington State Register and on the internet at the DSHS Rule-Making Hearing Docket Website.
