HCBS – COPES Draft Waiver Amendment Application

The Centers for Medicare and Medicaid Services (CMS) require States to seek public input when submitting an application for a renewal or an amended 1915c waiver.

The COPES Waiver operated by Aging and Long-Term Support Administration (ALTSA), will be amended effective 1/1/2020 for the following purpose:

HCA and ALTSA intend to submit waiver amendment applications for the COPES, New Freedom, and Residential Support waiver programs to add a new eligibility group who qualify for the programs due to changes in eligibility to the Apple Health for Workers with Disabilities (HWD).  The new eligibility group allows workers with disabilities who are age 65 or older to buy into Medicaid under the Balanced Budget Act of 1997 (BBA) working disabled group as provided in 1902 (a)(10)(A) (ii)(XIII)) of the Social Security Act. This eligibility group allows working individuals with disabilities to qualify for the state plan medical and waiver programs.   The effective date of this change will be January 1, 2020.

DSHS welcomes all comments on the draft waiver amendment. Comments may be submitted to DSHS through the website address listed above or may be mailed to Jamie Tong at the address listed below. DSHS will receive comments through 5:00 pm close of business on March 9, 2020.
