Notification of the DLR Emergency WACs that went into effect June 23, 2017

The emergency WAC went into effect on June 23, 2017. Please see the attachment SHS-4631.2 for the new WAC language. The changes are underlined. The other documents also included in the filing are attached. The CR-102 will be filed in the next 60 days. Once the CR-102 is filed a public hearing will be scheduled and you will be notified how to provide comment and the time and location of the hearing in case you want to attend in person.   

The emergency rule making relates specifically to fire safety, weighted blankets, and food requirements.

WAC 388-145 Group Care Changes:

  • The group care WAC now aligns with the state-adopted building code requirements.
  • The new WAC will no longer require group care facilities that are fire sprinkler protected and approved by the fire marshal or building official to have windows that open to the outside or allow for emergency personnel to enter and exit.
  • The WAC now requires smoke detectors to be installed both inside and outside of all bedrooms in all group care facilities in accordance with the state-adopted building codes.

WAC 388-148 Foster Home Changes:

  • The WAC requires smoke detectors to be installed both inside and outside of all bedrooms in foster homes in accordance with the state-adopted building codes.
  • The WAC clarifies when weighted blankets can be used for foster children.  
  • The WAC states that neither formula nor breast milk can be warmed in a microwave oven.

These changes to existing WACs were requested by group care facilities, the state fire marshal, and the Children’s Administration’s Regional Medical Consultants.
