Chapter 388-112A WAC

The purpose of this rulemaking is “housekeeping”, replacing the current WAC language in several sections of chapter 388-112A WAC that currently refer to Department of Health (DOH) rules) with a simple reference to the DOH chapter 246-980 WAC. We are proposing to replace all current references to the 200 days allowed for Home Care Aide (HCA) and Nursing Assistant - Certified (NAC) certification with a direct reference to chapter 246-980 WAC. That chapter (including WAC 246-980-025, 246-980-030, 246-980-040, and 246-980-065) is where DOH has codified legislation setting these deadlines and where DOH has made changes to the timeframes for HCA and NAC certification. The Department of Social and Health Services (DSHS) must change the WAC sections below so that the correct reference can be written.  WAC Chapters and Sections to be updated include: 388-112A-0010, 388-112A-0050, 388-112A-0060, 388-112A-0070, 388-112A-0090, 388-112A-0105, and 388-112A-0110

Chapters 388-76, 388-78A & 388-107

This proposal corrects a typographical error in an email address and adds a physical address to the long-term care ombuds contact information in WAC 388-76-10617 Resident rights—Transfer and discharge notice—Residents with medicaid as a payor, 388-78A-2661 Resident rights—Transfer and discharge notice—Residents with medicaid as a payor., and 388-107-0281 Transfer and discharge notice—Residents with medicaid as a payor. This proposal adds a phone number for the long-term care discharge defense screening line, which was not yet established when the rules were drafted. This applies to the following sections: WAC 388-76-10506 Written residency agreement—Residents with medicaid as a payor, 388-76-10617 Resident rights—Transfer and discharge notice—Residents with medicaid as a payor, 388-78A-2651 Written residency agreement—Residents with medicaid as a payor, 388-78A-2661 Resident rights—Transfer and discharge notice—Residents with medicaid as a payor, 388-107-0161 Written residency agreement—Residents with medicaid as a payor, and 388-107-0281 Transfer and discharge notice—Residents with medicaid as a payor. These amendments will help the regulated entities meet the requirements of the chapter(s).

WAC 388-97-1090

WAC 388-97-1090 – Direct care hours. RCW 74.42.360(2)(d)(vi): The department’s authority to grant exceptions to the WA State minimum direct care nursing 3.4 hours per resident day (HPRD) requirement expired on June 30, 2018. Rulemaking is being completed to repeal expired exception/waiver information.

The department is planning to amend 388-112A-1292 - What are the minimum qualifications for community instructors to teach expanded specialty trainings?

WAC 388-112A-0010

The department is planning to amend a section in the Residential Long-Term Care Services Training Chapter under WAC 388-112A-0010 What definitions apply to this chapter? The purpose of the amendment is to correct an error in an RCW reference in WAC 388-112A-0010(2). The RCW reference number is incorrect and should be RCW 41.56.029.

The department is planning to amend WAC 388-71-0752, 388-71-1055, 388-112A-0090, 388-112A-0495, 388-112A-0610, 388-112A-0611, 388-112A-0612, 388-112A-1240, and 388-112A-1245. The purpose of the amendments is to update training rules to recognize registered nurses licensed under chapter 18.80 RCW, the new interstate nurse licensure compact. Other minor edits related to grammar and consistency are also included.

The Department intends to repeal WACs 388-71-0876, 388-71-0992, 388-112A-0081, and 388-112A-0613. The purpose is to remove the COVID-19 training and continuing education extension rules that are no longer necessary.
