Secretary's List of Crimes and Negative Actions

The Secretary of DSHS approved the Secretary's List of Crimes and Negative Actions (Secretary's List), based on state and federal law and regulation.

Effective July 25, 2014: The Aging and Long-Term Support Administration and Developmental Disabilities Administration crimes lists will be combined.

Chapter 388-113 WAC: Disqualifying Crimes and Negative Actions for programs administered by Aging and Long-Term Support Administration and Developmental Disabilities Administration for people working or serving with unsupervised access to vulnerable adults, juveniles, and children:

  • Home and Community Services Division programs including, but not limited to:
    o   In-home Service Providers
    o   Home Care Agencies
    o   Individual Providers
  • Residential Care Services Division programs including, but not limited to:
    o   Nursing Homes
    o   Assisted Living Facilities
    o   Adult Family Homes
  • Developmental Disabilities Administration including, but not limited to:
    o   Group Homes
    o   Providers

The Secretary's List for programs administered by Children's Administration, for people working or serving with unsupervised access to children:

  • Children's Administration programs including, but not limited to:
    o   Foster Care Licensing
    o   Adoptions
    o   Providers

The Secretary's List for all other people working or serving with unsupervised access to vulnerable adults, juveniles, and children in programs administered by the Department including, but not limited to:

o   Economic Services Administration
o   Financial Services Administration
o   Juvenile Justice and Rehabilitation Administration
o   Division of Vocational Rehabilitation
o   Special Commitment Center
o   Office of Deaf and Hard of Hearing
o   All other programs and state employees
