Will DCS negotiate on the amount needed to satisfy the lien?

DCS gives reasonable claim-related attorney fees and costs as well as negotiated medical expenses priority over the child support lien under RCW 26.23.037 The Division of Child Support’s interest lies in the net amount the client would receive if the child support lien not been in place.

Typically, if the net proceeds are more than the total child support debt owed at the time of settlement, DCS will require the full debt balance to be paid.

DCS’s Special Collections Unit reviews requests to negotiate on a case-by-case. Please contact the Special Collections Unit at LSC@dshs.wa.gov to discuss the settlement.
