The proposed rule implements Section 16 of Engrossed Substitute Senate Bill 5291 (Chapter 380, Laws of 2025) for a pilot project from January 1, 2026, through June 30, 2026. The draft rules establish parameters for the pilot project, including participating locations, capacity limitations, approved services limitations, and other topics necessary for the pilot.

Chapter 388-848 WAC

Chapter 388-848 WAC, Civil Transitions Program. DDCS is adopting new sections of rule to implement Engrossed Second Substitute Senate Bill 5440 (2023), which directs DSHS to develop a process for connecting individuals who have been found not competent to stand trial due to an intellectual or developmental disability to available wraparound services and supports in community-based settings. DDCS has previously submitted emergency rules to cover the initial implementation of the services and is seeking to make the full Chapter 388-848 WAC permanent.
