ALTSA:  ICF/IID #2014-003

Dear ICFs/IID Superintendents and Interested Parties:

In August and December 2013, Residential Care Services (RCS) informed you about possible changes to Residential Habilitation Center rules.  The department recently filed the final Rule-Making Order (CR-103P) for amendments to Chapter 388-111 WAC, Residential Habilitation Centers – Compliance Standards, with the Office of the Code Reviser.  The rule became effective on May 30, 2014 and is published in the Washington State Register as WSR 14-10-034.

The purpose of amending these rules is to comply with Substitute House Bill (SHB) 2056 (Chapter 10, Laws of 2012) passed in the 2012 legislative session.  The chapter is also being amended to comply with federal law regarding terminology used in Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/IID) regulations.

Highlights of the changes are:

  • Replaces the term "boarding home" with "assisted living facility" to be consistent with amendments to Chapter 18.20 RCW.
  • Changes references to "mental retardation" to "intellectual disability" and changes all references to "mentally retarded individual" to "an individual with an intellectual disability."

Enclosed is the CR-103.  You can also access this on the ALTSA website under the heading, "ICF/IID Rule Filings", at: http://www.altsa.dshs.wa.gov/professional/icfid.htm.

After the effective date, when the rule language is "codified" and merged into the existing WAC chapter, you will be able to read and print them out from the computer by visiting http://apps.leg.wa.gov/WAC/default.aspx?cite=388-111.

Thank you for your continued support of and commitment to clients living in ICFs/IID.  If you have any questions, please contact Loida Baniqued, Interim Quality Assurance Administrator at (360) 725-2419 or by e-mail at BaniqLC@dshs.wa.gov
