FINAL AMENDMENTS RELATED TO CHAPTER 388-111 WAC

Dear ICFs/IID Superintendents and Interested Parties:

In August and December 2013, Residential Care Services (RCS) informed you about possible changes to Residential Habilitation Center rules.  The department recently filed the final Rule-Making Order (CR-103P) for amendments to Chapter 388-111 WAC, Residential Habilitation Centers – Compliance Standards, with the Office of the Code Reviser.  The rule became effective on May 30, 2014 and is published in the Washington State Register as WSR 14-10-034.

The purpose of amending these rules is to comply with Substitute House Bill (SHB) 2056 (Chapter 10, Laws of 2012) passed in the 2012 legislative session.  The chapter is also being amended to comply with federal law regarding terminology used in Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/IID) regulations.

Highlights of the changes are:

  • Replaces the term "boarding home" with "assisted living facility" to be consistent with amendments to Chapter 18.20 RCW.
  • Changes references to "mental retardation" to "intellectual disability" and changes all references to "mentally retarded individual" to "an individual with an intellectual disability."
