ELIMINATION OF TIME LIMITED AGREEMENTS

Dear ICF/IID Administrator/Superintendent:

Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/IID) will no longer be certified under time-limited agreements.  The Centers for Medicare & Medicaid Services (CMS) recently amended Chapter 42 CFR 442 to provide that provider agreements for ICFs/IID would remain in effect as long as the facility remains in compliance with the Conditions of Participation (COP).

ICFs/IID must be surveyed for re-certification an average of every 12 months and at least once every 15 months.  In some cases a facility's regular survey may occur less than a year after its previous survey.  In other cases, it may be more than a year after the prior survey.

If a facility fails to meet standards for participation during a survey, the facility may remain certified if:

  • The survey agency finds Immediate Jeopardy does not exist, and
  • The facility provides an acceptable plan of correction.

A facility may be decertified if an immediate jeopardy finding remains uncorrected after 23 days or if it fails to regain compliance with conditions of participation after 90 days.
