Emergency Extension and final amendments related to chapter 388-78A WAC

Dear Assisted Living Facility Administrator and Interested Parties:

In March, June and July 2012, Residential Care Services (RCS) informed you of proposed changes to the assisted living facility licensing rules.  The department filed the permanent rules which become effective November 18, 2012.  In addition, the department recently filed an emergency rule extension on October 8, 2012 since permanent rules will not take effect in time. 

The department is amending, adding new sections, and repealing a section of the rules to comply with and be consistent with Initiative 1163 and Engrossed Substitute House Bill (ESHB) 2314 to:

  • Clarify background check requirements; and
  • Clarify the provision of disqualifying drug crimes.
