CR 103 Emergency Extension Filed to chapter 388-76 WAC

Dear Adult Family Home Provider:

In February 2012, you had received a letter notifying you that the Department had filed emergency rules for Chapter 388-76 Washington Administrative Code (WAC) with the Office of the Code Reviser.  The Department had filed these emergency rules to clarify background check requirements from Initiative 1163 and to comply with 2011 legislative changes to chapter 70.128 Revised Code of Washington (RCW).  This letter is to inform you that we have filed an extension to those emergency rules because they will expire this month.

Since emergency rules are not permanent, the Department is in the process of adopting permanent rules.  The CR-102 was filed with the Office of the Code Reviser on April 17, 2012 and the public hearing was held on June 5, 2012. These rule changes include clarification of the fingerprint background check and on-site caregiver requirements.

You can find the enclosed CR-103E and related documents along with the rule changes on the Aging and Disability Services Administration (ADSA) internet website on the Adult Family Home Professionals page at http://www.adsa.dshs.wa.gov/professional/afh.htm under the heading "AFH Rule Filings".

Thank you for your continued commitment to residents living in adult family homes.

Sincerely,

Joyce Pashley Stockwell, Director
Residential Care Services
